El Dorado County residents have 30 days to weigh in on a proposed commercial cannabis cultivation project after the county opened a public comment period on Monday, Sept. 14.

The county published a Notice of Intent to adopt a Mitigated Negative Declaration for the project on Friday, Sept. 11. A Mitigated Negative Declaration, or MND, is a finding under the California Environmental Quality Act (CEQA) that a project will not cause significant environmental harm once certain mitigation measures are applied.

The comment window runs through Tuesday, Oct. 13, according to the county's public notices page. The project-specific notice lists Oct. 14 as the closing date. Residents should confirm the deadline with the Planning Division before submitting late comments.

What's known about the project

The permit application, labeled CCUP22-0001/BH&2K, was filed in 2022 and is tied to Assessor's Parcel Number 094-090-010. The county has not publicly identified the applicant behind the "BH&2K" label. The notice does not describe the scale, acreage or type of cultivation proposed.

This is a cultivation permit, not a retail storefront. The county caps retail cannabis storefronts at seven and is no longer accepting retail applications.

The project has moved slowly through the county's review process. It appeared on the El Dorado County Agricultural Commission's agenda on Oct. 8, 2025, but was continued off calendar without action, according to commission records.

Broader cannabis permit pipeline

As of Sept. 30, 2023, the most recent quarterly data available, El Dorado County had approved 10 Cannabis Conditional Use Permits with 12 more in processing, according to county planning reports. No new applications had been filed in fiscal year 2023-24.

Separately, the El Dorado County Planning Commission voted July 9 to recommend the Board of Supervisors approve changes to cannabis setback rules for parcels owned or leased before Nov. 6, 2018. Whether those amended setbacks apply to this parcel is not stated in available county records.
